Housing Justice Win! SD Passes No Fault Eviction Moratorium
Let’s celebrate a housing justice win!
We teamed up with the Legal Aid Society of San Diego on Monday, April 4th to present in favor of the City of San Diego No Fault Eviction Moratorium.
Many landlords have used the No-Fault reasons allowed under city law to evict tenants without providing proof of their intent to comply with the law.
Examples of No-Fault reasons include an owner or owner's family member who wants to move in (no requirement that the owner actually move in), an owner's seeming desire to substantially remodel the unit (with no current requirement for permits to be issued), and an owner who wants to remove all units on a particular parcel from the rental market (with no requirement or proof that the units stay off the market for a certain time period).
The temporary moratorium places additional restrictions on the landlords to avoid abuse of these provisions and hopefully displace fewer tenants. They require permits to be issued in the case of substantial remodels and longer notice time periods for owners who want to move in or remove the property from the rental market.
